 ACTION ALERT! 1/8/07: Stu, Los Angeles "Evidence Dog," Pulled From Rescue And Back In Pound

Is this the same dog as pictured at his impound above? 25% overweight and denied vet care by Ed Boks.

 

 1.05.07 Email to the Rescue re: 12/23 /06 visit. Stu was allowed to stay at this rescue for 4 months where he enjoyed fresh air, my food and baths and exercise. Then he was abruptly pulled from the rescue and slammed behind glass at the North Central Los Angeles Animal shelter. Tia is the owner of a Pit Bull rescue. Here's the account of why he's not there anymore.

I feel it's necessary to clarify today's events. When your daughter, Tanya, was first letting Stu out of his kennel, she asked me, "Does he walk with you on a leash?"
 
I replied, "Yes, why?" "Doesn't he walk with you on a leash?"
 
She said,  "  Oh I never use a leash when I walk him."
 
When I was ready to leave , there was nobody around. Tanya had taken the leash that I had hung on the fence for Stu, so since she had implied that she lets him walk himself around the kennel, I did not think it a problem to get him back in his space.
 
While I certainly understand that it is your kennel  and that your rules must be followed, I have never been told of any rules or conditions for my visits, so you can imagine my shock when Stu's collar, which I  was holding, was  forcibly pulled out of my hand by your employee (whom I have never met and whose name I do not know). This forced  action resulted in the collar slipping off Stu's neck leaving him loose. I held him and we put the collar back on. I see no reason for the belligerent behavior by your employee or his ordering me off the property over a simple mistake which resulted in no incident.
 
Stu neither barked nor did he growl at any other dog, nor did he engage in any presumed "fence fight"  with any other dog for the 10 seconds in which he was "loose" in your secure kennel; and there were no other dogs outside of their kennels; nor was any disturbance caused except because of your employee yelling at me that Stu "already has issues" and "Let go of the dog!"
 
I also have   often observed several dogs, including pit bulls or mixes roaming "loose" on your property. You know that Stu is not dog aggressive or aggressive toward people. If you believe otherwise you should let me know the basis of this belief as well.
 
 
Since you would not speak with me before I left, I must ask  that if your intention is to prevent me from visiting my dog in the future (as your employee implied), I would appreciate you saying so now so that I may act accordingly. It was my intention to visit a couple of times over the holiday week.
 
 You can be assured that I would never allow him to be loose. And again, I'm sorry to have caused you any distress.
 
I don't know what has caused  your new animosity toward me-- even before today's visit. Previously, you have been very amicable, have invited  me to visit "anytime you want", "give him a bath", etc., etc. Clue me in, please.

P.S. It's been 3 months since Boks assured me that Stu would be examined "nose to tail" by a vet. I assume he has not been as I have heard of no results. Because he continues to be extremely overweight and is the only dog that I have observed on your property that is fat,I am concerned that he is ailing from something. He has never been overweight in 6 years. Please let me know if and when you plan for him to be examined. Thanks.

 Please note that Mr. Boks ( hours 9-5) visited Stu's pages  7 times on 12/7, the day immediately preceeding the "raid."  Then , on 12/8-- the day of the "raid" Mr. Boks is up early and on Stu's pages at 7:30 AM!? Coincidence? We think not.

    The reprisals for my dog rescue efforts heat up.

    I have rescued 4 dogs from the killing rooms of the Los Angeles City Pounds.  Two are adopted, two are seeking foster homes or permanent homes. None of the dogs reside on my property, yet when a dog from my neighborhood is reported as being "at large," the Dept. of Animal Sevices launched an offensive on my home.

     Stu's Dad's RESPONSE TO Ed Boks 12.8.06 "Raid"

    11.4.06 Animal "Services"  Threatens to Kill Stu- AGAIN .

    In August of 2006,  when the public demanded in hundreds of calls, letters, emails and faxes to the City of Los Angeles and the Mayor, that the Department of Animal Services spare the life of Stu, Ed Boks agreed to "re-open his case." Boks then proceeded to block every effort to get to the truth of the matter --that Stu is not and has never been a "Dangerous Animal".

     In September , 2006 after numerous denied requests  ( denied by Ed Boks) from my attorney to have Stu professionally evaluated by a Certified Dog Behaviorist, Stu was  finally evaluated outside the so-called "shelter" in which he had been confined for 12 months  (see myspace.com/save_stu for photos of his horrid condition there).  This thorough evaluation was performed by Dr. Richard Polsky , PhD.,

    Dr. Polksy had been retained by my attorney to perform Stu's video taped evaluation and to prepare a report. Dr. Polksy would testify at trial if necessary. Prior to the evaluation, and after being warned by my attorney not to contact the Doctor (It is unethical and illegal to attempt to tamper with a witness), Ed Boks, the General Manager of Animal Services and co-defendant in de la Rosa vs. City of Los Angeles, proceeded to telephone Dr. Polsky and offer him employment. Huh? There seems to be no end to this department eager willingness to bend and break the law when it comes to killing animals.

    After a 2+ hour session attended by Tia Maria Torres (from Villalobos Pit Bull Rescue) , my attorney and myself,  Stu performed wonderfully,  dutifully obeying all commands even though he had not seen me but once in nearly 6 months. He only showed any aggression when the Doctor feigned an attack while beating a stick on the ground or when an umbrella was opened in his face to startle him. He did growl when the Doctor attempted to take food from him, a natural reaction from a dog confined to a kennel for a year and surrounded by countless distressed barking dogs. A full report complete with video would be compiled by the doctor and submitted as evidence.

     In November, the Animal Services Board of Commissioners' Secretary, Ross Pool, whose job description is still a mystery, phoned my attorney and left the following recorded voice mail  message (paraphrased) : "We haven't received the evaluation yet. I'm going to recommend the dog be euthanized." (As far as I know, Mr. Pool has no authority other than to hold a stopwatch at commission meetings and to yell out "time" when a speaker's 3 minutes have expired.

    In response, my attorney immediately faxed Dr. Polksy's preliminary report of Stu's evaluation and then attempted to contact the City Attorney, Ed Boks and Mr. Pool. The Doctor's report, in short, described Stu as a dog which is "not dangerous."  

    Since that day, the City and Animal Services have not responded to any contact attempts made by my attorney and Stu's fate is again unknown.
